“…It is my professional opinion, based on my 48 years in the credit union industry (33 years as a regulator and 15 years as a consultant), that WCU clearly committed and violated not only a verbal agreement to finance the entire Thornton project to a total of approximately $7 million, but also committed a breach of a written contract involving the loaning of $500,000…” Allen Carver – Former Regional Director, National Credit Union AdministrationServing in his position as both President and CEO of WCU, Kenyon wields tremendous authority over everything related to the credit union business. However, despite Kenyon’s authority, there is one thing that he doesn’t possess and that is “power of attorney” to transfer property. Click the link below to bring up the only legal document produced to establish Thorco’s rightful ownership of their property, which was issued by Title Financial Specialty Services, the only attorney-in-fact legally allowed to transfer property for WCU. Satisfaction of Mortgage Document – Issued by Title Financial Specialty Services Without having a power of attorney, any action by Kenyon to transfer property into the ownership of the credit union would, according to Montana Code Annotated (MCA), be considered theft. The link below will bring up the document that Kenyon filed with the Flathead County Clerk and Recorder’s office which appears to be an illegal attempt to steal back a piece of property that WCU legally transferred to the borrower. James Kenyon’s “Corrected Release of Mortgage” document appears unlawful under the MCA and also appears to be an attempt at property theft. Below is a video taken by Dennis Thornton, WCU crime victim and President of Thorco, Inc., at the Flathead County Clerk and Recorder’s office. In the video, you can see and hear the clerk state that there is no other power of attorney on record for WCU besides Title Financial Specialty Services, which makes the actions of WCU President and CEO James Kenton III a crime, according to MCA To further illustrate the breadth and depth of what appears to be unlawful activity perpetrated by Kenyon and his associates, portions of the MCA which outline the proper procedure for the transfer of property are included below. Obviously, any actions that were taken by WCU or their agents which do not conform to the MCA are violations of the Montana Code and, by default, a violation of Montana law.
